What are your options if you cannot return to work after an injury?

Workplace injuries forced over 22,800 Minnesota workers to miss at least one day of work, according to recent data. Some workers returned, while others did not. This report highlights that serious injuries can make returning to work impossible. For those workers, the law provides specific options to help replace lost income, cover medical care or support a change in employment.

Four options Minnesota workers may have after a disabling injury

When a worker cannot return to their job because of a permanent injury, several programs under the workers’ compensation system may apply. These include:

  • Permanent total disability (PTD) benefits: PTD benefits provide long-term wage replacement to workers who can no longer perform any type of substantial gainful employment. The amount and duration depend on the injury and how it affects work capacity.
  • Vocational rehabilitation and retraining: Some workers qualify for help finding a new type of work. These services may include skills assessments, retraining, job placement or on-the-job support. The goal is to identify realistic employment options based on current abilities.
  • Medical care and support services: Workers’ compensation covers reasonable and necessary medical treatment related to the injury. That can include surgeries, medications, therapy, prosthetics and modifications to the home or vehicle. Mileage and travel costs to appointments may also be reimbursed.
  • Structured settlements or lump-sum payments: In some cases, a claim may be resolved through a settlement, which can either be one-time or a series of payments over time. A settlement must consider future wage loss and medical needs.

Each option depends on the nature of the injury, medical restrictions and past work history. Often, more than one benefit may apply.
